104. (1) जो कोई किसी व्यक्ति की मृत्यु किसी ऐसे उतावले या लापरवाही भरे कार्य द्वारा, जो गैर इरादतन हत्या की कोटि में नहीं आता है, कारित करता है, तो उसे किसी एक अवधि के लिए कारावास से, जो सात वर्ष तक का हो सकेगा, दण्डित किया जाएगा और वह जुर्माने से भी दण्डनीय होगा।

104. लापरवाही के कारण मृत्यु होना
(2) जो कोई किसी व्यक्ति की मृत्यु किसी ऐसे उतावले या लापरवाही भरे कार्य द्वारा, जो गैर इरादतन हत्या की कोटि में नहीं आता है, कारित करता है और घटना स्थल से भाग जाता है या घटना के तुरन्त बाद पुलिस अधिकारी या मजिस्ट्रेट को घटना की सूचना देने में असफल रहता है, तो उसे किसी एक अवधि के लिए कारावास से, जो दस वर्ष तक का हो सकेगा, दण्डित किया जाएगा और वह जुर्माने से भी दण्डनीय होगा।

104. (1) Whoever causes the death of any person by doing any rash or negligent act not amounting to culpable homicide, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.

(2) Whoever causes death of any person by doing any rash or negligent act not amounting to culpable homicide and escapes from the scene of incident or fails to report the incident to a Police officer or Magistrate soon after the incident, shall be punished with imprisonment of either description of a term which may extend to ten years, and shall also be liable to fine.
