किशोर न्याय अधिनियम की धारा 94 JJ Act Section-94 के तहत किशोर न्याय बोर्ड (जेजेबी) समिति या बोर्ड, जिसके समक्ष बालक, इस अधिनियम के किसी उपबंध के अधीन लाया जाता है, जब भी वह ऐसा करना ठीक समझे, बालक का वास्तविक भारसाधन रखने वाले माता-पिता या संरक्षक से अपेक्षा कर सकेगा। कि वह उस बालक के बारे में किसी कार्यवाही में उपस्थित हों।

आयु के विषय में उपधारणा और उसका अवधारण-
( 1 ) जहां बोर्ड या समिति को, इस अधिनियम के किसी उपबंध के अधीन (साक्ष्य देने के प्रयोजन से भिन्न) उसके समक्ष लाए गए व्यक्ति उपसंजाति के आधार पर यह स्पष्ट होता है कि उक्त व्यक्ति बालक है तो समिति या बोर्ड बालक की यथासंभव सन्निकट आयु का कथन करते हुए ऐसे संप्रेक्षण को अभिलिखित करेगा और आयु की और अभिपुष्टि की प्रतीक्षा किए बिना, यथास्थिति, धारा 14 या धारा 36 के अधीन जांच करेगा।
(2) यदि समिति या बोर्ड के पास इस संबंध में संदेह होने के युक्तियुक्त आधार हैं कि क्या उसके समक्ष लाया गया व्यक्ति बालक है या नहीं, तो यथास्थिति, समिति या बोर्ड, निम्नलिखित साक्ष्य अभिप्राप्त करके आयु अवधारण की प्रक्रिया का जिम्मा लेगा-
(i) विद्यालय से प्राप्त जन्म तारीख प्रमाण-पत्र या संबंधित परीक्षा बोर्ड से मैट्रिकुलेशन या समतुल्य प्रमाण-पत्र, यदि उपलब्ध हो; और उसके अभाव में,
(ii) निगम या नगरपालिका प्राधिकारी या पंचायत द्वारा दिया गया जन्म प्रमाण-पत्र ;
(iii) उपरोक्त (i) और (ii) के अभाव में, आयु का अवधारण समिति या बोर्ड के आदेश पर की गई अस्थि जांच या कोई अन्य नवीनतम चिकित्सीय आयु अवधारण जांच के आधार पर किया जाएगा:
परंतु समिति या बोर्ड के आदेश पर की गई ऐसी आयु अवधारण जांच ऐसे आदेश की तारीख से पंद्रह दिन के भीतर पूरी की जाएगी।
(3) समिति या बोर्ड द्वारा उसके समक्ष इस प्रकार लाए गए व्यक्ति की अभिलिखित आयु, इस अधिनियम के प्रयोजन के लिए उस व्यक्ति की सही आयु समझी जाएगी।
Juvenile Justice Act Section-94 (JJ Act Section-94 in English)
Presumption and determination of age-
(1) Where, it is obvious to the Committee or the Board, based on the appearance of the person brought before it under any of the provisions of this Act (other than for the purpose of giving evidence) that the said person is a child, the Committee or the Board shall record such observation stating the age of the child as nearly as may be and proceed with the inquiry under section 14 or section 36, as the case may be, without waiting for further confirmation of the age.
(2) In case, the Committee or the Board has reasonable grounds for doubt regarding whether the person brought before it is a child or not, the Committee or the Board, as the case may be, shall undertake the process of age determination, by seeking evidence by obtaining—
(i) the date of birth certificate from the school, or the matriculation or equivalent certificate from the concerned examination Board, if available; and in the absence thereof;
(ii) the birth certificate given by a corporation or a municipal authority or a panchayat;
(iii) and only in the absence of (i) and (ii) above, age shall be determined by an ossification test or any other latest medical age determination test conducted on the orders of the Committee or the Board:
Provided such age determination test conducted on the order of the Committee or the Board shall be completed within fifteen days from the date of such order.
(3) The age recorded by the Committee or the Board to be the age of person so brought before it shall, for the purpose of this Act, be deemed to be the true age of that person.
