मोटर वाहन अधिनियम की धारा- 110 का विवरण

मोटर वाहन अधिनियम (Motor Vehicles Act) की धारा -110 के विषय में पूर्ण जानकारी देंगे। इस अध्याय के अधीन केन्द्र सरकार को अपने नियम बनाने की शक्ति होती है, इसके अलावा नियमो मे बदलाव करने की शक्ति होती है।

मोटर वाहन अधिनियम की धारा- 110 के अनुसार

केन्द्रीय सरकार की नियम बनाने की शक्ति-

(1) केन्द्रीय सरकार मोटर यानों और ट्रेलरों के निर्माण, उपस्कर और अनुरक्षण का विनियमन करने के लिए निम्नलिखित सभी बातों या उनमें से किसी की बाबत नियम बना सकेगी, अर्थात् :-
(क) यानों की ओर से जाए जाने वाले भार की चौड़ाई, ऊंचाई, लम्बाई और प्रलंब;
(ख) टायरों का आकार, प्रकार, अधिकतम खुदरा कीमत और हालत जिसके अन्तर्गत विनिर्माण की तारीख और वर्ष का उस पर समुद्धृत किया जाना है और अधिकतम भार वहन क्षमता;
(ग) ब्रेक और स्टीयरिंग गियर;
(घ) सुरक्षा कांच का प्रयोग, जिसके अंतर्गत कलईदार सुरक्षा कांच के प्रयोग का प्रतिषेध है;
(ङ) संकेतन-साधित्र, लैम्प और परावर्तक;
(च) गति नियंत्रक;
(छ) धुएं, दिखाई देने वाली भाप, चिंगारी, राख, बाल-कण या तेल का उत्सर्जन;
(ज) यानों से निकलने वाली या होने वाली आवाज को घटाना;
(झ) चैसिस संख्यांक तथा इंजन संख्यांक और विनिर्माण की तारीख का उत्कीर्ण होना;
(ञ) सुरक्षा पट्टियां, मोटर साइकिलों की हैंडिल शलाका, ऑटो-डिपर और ड्राइवरों, यात्रियों और सड़क का उपयोग करने वाले अन्य व्यक्तियों के लिए आवश्यक अन्य उपस्कर;
(ट) यान में अन्तःनिर्मित सुरक्षा युक्तियों के रूप में प्रयुक्त संघटकों के मानक जिसके अंतर्गत साफ्टवेयर है;
(ठ) मानव जीवन के लिए खतरनाक या परिसंकटमय प्रकृति के माल के परिवहन के लिए उपबंध
(ड) वायु प्रदूषकों के उत्सर्जन के लिए मानक :
(ढ) विहित किए जाने वाले यानों के वर्ग में उत्प्रेरक परिवर्तक का लगाया जाना;
(ण) सार्वजनिक यानों में दृश्य-श्रवण या रेडियो या टेपरिकार्डर जैसी युक्तियों का लगाया जाना;
(त) यान के विक्रय के पश्चात् वारंटी और उसके लिए मानक :
परन्तु पर्यावरण के संरक्षण से संबंधित विषयों के संबंध में कोई नियम, जहां तक हो सके, भारत सरकार के पर्यावरण से संबंधित मंत्रालय से परामर्श करने के पश्चात् बनाए जाएंगे।
(2) उपधारा (1) के अधीन उसमें वर्णित बातों को शासित करने वाले नियम बनाए जा सकेंगे जिनके अन्तर्गत ऐसी बातों का अनुपालन सुनिश्चित कराने की रीति और ऐसी बातों की बाबत या तो साधारणतया मोटर यानों या ट्रेलरों की बाबत या किसी विशिष्ट वर्ग या विशिष्ट परिस्थितियों में और ऐसे नियम अन्वेषण की प्रक्रिया, ऐसा अन्वेषण संचालित करने के लिए सशक्त अधिकारी, ऐसे विषयों की सुनवाई के लिए प्रक्रिया तथा उनके तद्धीन उदगृहीत की जाने वाली शास्तियां मोटर यानों या ट्रेलरों की बाबत मोटर यानों के अनुरक्षण भी हैं।
(2क) उपधारा (2) में निर्दिष्ट अन्वेषणों के संचालन के लिए उपधारा (2) के अधीन सशक्त व्यक्तियों को सिविल प्रक्रिया संहिता, 1908 (1908 का 5) के अधीन निम्नलिखित विषयों के संबंध में सिविल न्यायालय की सभी शक्तियां होंगी, अर्थात् :-
(क) किसी व्यक्ति को समन करना और हाजिर करना तथा शपथ पत्र पर उसकी परीक्षा;
(ख) किसी दस्तावेज की मांग और प्रस्तुत करने की अपेक्षा;
(ग) शपथ पत्र पर साक्ष्य प्राप्त करना; और
(घ) कोई अन्य विषय, जो विहित किया जाए।
(3) इस धारा में किसी बात के होते हुए भी-
(क) केन्द्रीय सरकार, किसी वर्ग के मोटर यानों को इस अध्याय के उपबंधों से छूट दे सकेगी;
(ख) कोई राज्य सरकार, किसी मोटर यान या किसी वर्ग या वर्णन के मोटर यानों को उपधारा (1) के अधीन बनाए गए नियमों से ऐसी शर्तों के अधीन रहते हुए छूट दे सकेगी जो केन्द्रीय सरकार द्वारा विहित की जाएं।

Power of Central Government to make rules-
(1) The Central Government may make rules regulating the construction, equipment and maintenance of motor vehicles and trailers with respect to all or any of the following matters, namely :-
(a) the width, height, length and overhang of vehicles and of the loads carried;
(b) the size, nature, maximum retail price and condition of tyres, including embossing thereon of date and year of manufacture, and the maximum load carrying capacity;
(c) brakes and steering gear;
(d) the use of safety glasses including prohibition of the use of tinted safety glasses;
(e) signalling appliances, lamps and reflectors;
(f) speed governors;
(g) the emission of smoke, visible vapour, sparks, ashes, grit or cai;
(h) the reduction of noise emitted by or caused by vehicles;
(i) the embossment of chassis number and engine number and the date of manufacture;
(j) safety belts, handle bars of motor cycles, auto-dippers and other equipments essential for safety of drivers, passengers and other road users,
(k) standards of the components [including software,] used in the vehicle as inbuilt safety devices;
(l) provision for transportation of goods of dangerous or hazardous nature to human life;
(m) standards for emission of air pollutants:
(n) installation of catalytic converters in the class of vehicles to be prescribed;
(o) the placement of audio-visual or radio or tape recorder type of devices in public vehicles;
(p) warranty after sale of vehicle and norms therefore:
Provided that any rules relating to the matters dealing with the protection of environment, so far as may be, shall be made after consultation with the Ministry of the Government of India dealing with environment.
(2) Rules may be made under sub-section (1) governing the matters mentioned therein, including the manner of ensuring the compliance with such matters and the maintenance of motor vehicles in respect of such matters, either generally in respect of motor vehicles or trailers or in respect of motor vehicles or trailers of a particular class or in particular circumstances and such rules may lay down the procedure for investigation, the officers empowered to conduct such investigations, the procedure for hearing of such matters and the penalties to be levied thereunder.
(2A) Persons empowered under sub-section (2) to conduct investigations referred to in sub-section (2) shall have all the powers of a civil court, while trying a suit under the Code of Civil Procedure, 1908 (5 of 1908) in respect of the following matters, namely:-
(a) summoning and enforcing the attendance of any person and examining him on oath;
(b) requiring the discovery and production of any document;
(c) receiving evidence on affidavit; and
(d) any other matter as may be prescribed.
(3) Notwithstanding anything contained in this section-
(a) the Central Government may exempt any class of motor vehicles from the provisions of this Chapter;
(b) a State Government may exempt any motor vehicle or any class or description of motor vehicles from the rules made under sub-section (1) subject to such conditions as may be prescribed by the Central Government.
