मोटर वाहन अधिनियम की धारा- 130 का विवरण
मोटर वाहन अधिनियम (Motor Vehicles Act) की धारा -130 के विषय में पूर्ण जानकारी देंगे। इस अध्याय के अधीन किसी सार्वजनिक स्थान में मोटर यान का ड्राइवर वर्दी पहने हुए किसी भी पुलिस अधिकारी द्वारा मांग की जाने पर अपनी अनुज्ञप्ति जांच के लिए पेश करना उस वाहन के वाहन स्वामी का कर्तव्य होता है।
मोटर वाहन अधिनियम की धारा- 130 के अनुसार
अनुज्ञप्ति और रजिस्ट्रीकरण प्रमाण-पत्र पेश करने का कर्त्तव्य-
(1) किसी सार्वजनिक स्थान में मोटर यान का ड्राइवर वर्दी पहने हुए किसी भी पुलिस अधिकारी द्वारा मांग की जाने पर अपनी अनुज्ञप्ति जांच के लिए पेश करेगा:
परन्तु ड्राइवर, जहां उसकी अनुज्ञप्ति इस अधिनियम या किसी अन्य अधिनियम के अधीन किसी अधिकारी या प्राधिकारी को प्रस्तुत की गई है या उसके द्वारा अभिगृहीत की गई है, अनुज्ञप्ति के स्थान पर उसके बारे में ऐसे अधिकारी या प्राधिकारी द्वारा जारी की गई रसीद या अन्य अभिस्वीकृति पेश कर सकेगा और तत्पश्चात् ऐसी अवधि के भीतर अनुज्ञप्ति, ऐसी रीति से जो केन्द्रीय सरकार विहित करे, मांग करने वाले पुलिस अधिकारी को पेश कर सकेगा।
(2) किसी सार्वजनिक स्थान पर मोटर यान का कंडक्टर, यदि कोई हो, इस निमित्त प्राधिकृत मोटर यान विभाग के अधिकारी द्वारा मांग किए जाने पर अनुज्ञप्ति जांच के लिए पेश करेगा।
(3) (धारा 60 के अधीन रजिस्ट्रीकृत यान से भिन्न) मोटर यान का स्वामी अथवा उसकी अनुपस्थिति में यान का ड्राइवर या अन्य भारसाधक व्यक्ति, रजिस्ट्रीकर्ता प्राधिकारी या मोटर यान विभाग के इस निमित्त सम्यक् रूप से प्राधिकृत किसी अन्य अधिकारी द्वारा मांग किए जाने पर, यान का बीमा प्रमाण-पत्र पेश करेगा और जहां यान कोई परिवहन यान है वहां, धारा 56 में निर्दिष्ट ठीक हालत में होने का प्रमाण-पत्र और परमिट भी पेश करेगा; और यदि कोई या सभी प्रमाण-पत्र अथवा परमिट उसके कब्जे में नहीं है तो वह मांग किए जाने की तारीख से पंद्रह दिन के भीतर उसकी सम्यक् रूप से अनुप्रमाणित फोटो प्रति, स्वयं प्रस्तुत करेगा या उस अधिकारी को जिसने उसकी मांग की है रजिस्ट्रीकृत डाक द्वारा भेजेगा।
स्पष्टीकरण- इस उपधारा के प्रयोजनों के लिए “बीमा प्रमाण-पत्र” से धारा 147 की उपधारा (3) के अधीन जारी किया गया प्रमाण पत्र अभिप्रेत है।
(4) यदि, यथास्थिति, उपधारा (2) में निर्दिष्ट अनुज्ञप्ति या उपधारा (3) में निर्दिष्ट प्रमाणपत्र या परमिट उस समय उस व्यक्ति के पास नहीं है जिससे उसकी मांग की गई है तो उस दशा में इस धारा का पर्याप्त अनुपालन हो जाएगा जब ऐसा व्यक्ति ऐसी अनुज्ञप्ति या प्रमाण-पत्र या परमिट को ऐसी अवधि के भीतर ऐसी रीति से जो केन्द्रीय सरकार विहित करे, पुलिस अधिकारी या मांग करने वाले प्राधिकारी को पेश करता है:
परन्तु इस उपधारा के उपबंध, किसी ऐसे व्यक्ति को, जिससे यह अपेक्षा की गई है कि वह परिवहन यान का रजिस्ट्रीकरण प्रमाण-पत्र या उसके ठीक हालत में होने का प्रमाण-पत्र पेश करे, उस विस्तार तक और ऐसे उपांतरण के सहित ही लागू होंगे जो विहित किए जाएं।
Duty to produce licence and certificate of registration-
(1) The driver of a motor vehicle in any public place shall, on demand by any police officer in uniform, produce his license for examination:
Provided that the driver may, if his license has been submitted to, or has been seized by, any officer or authority under this or any other Act, produce in lieu of the license a receipt or other acknowledgment issued by such officer or authority in respect thereof and thereafter produce the license within such period, in such manner as the Central Government may prescribe to the police officer making the demand.
(2) The conductor, if any, of a motor vehicle in any public place shall on demand by any officer of the Motor Vehicles Department authorized on this behalf, produce the license for examination.
(3) The owner of a motor vehicle (other than a vehicle registered under section 60) or in his absence the driver or other person in charge of the vehicle, shall, on demand by a registering authority or any other officer of the Motor Vehicles Department duly authorized in this behalf, produce the certificate of insurance of the vehicle and, where the vehicle is a transport vehicle, also the certificate of fitness referred to in section 56 and the permit; and if any or all of the certificates or the permit are not in his possession, he shall, within fifteen days from the date of demand, submit photocopies of the same, duly attested in person or send the same by registered post to the officer who demanded it.
Explanation- For the purposes of this subsection, “certificate of insurance means the certificate issued under sub-section (3) of section 147.
(4) If the license referred to in subsection (2) or the certificates or permit referred to in subsection (3), as the case may be, are not at the time in the possession of the person to whom the demand is made, it shall be sufficient compliance with this section if such person produces the license or certificates or permit within such period in such manner as the Central Government may prescribe, to the police officer or authority making the demand:
Provided that except to such extent and with such modifications as may be prescribed, the provisions of this subsection shall not apply to any person required to produce the certificate of registration or the certificate of fitness of a transport vehicle.
