मोटर वाहन अधिनियम की धारा- 56 का विवरण

मोटर वाहन अधिनियम (Motor Vehicles Act) की धारा -56 के विषय में पूर्ण जानकारी देंगे। इस अधिनियम के आधीन यदि कोई परिवहन मोटर यान की हालत ठीक नही है, तो इस अधिनियम के तहत ठीक होने का प्रमाण पत्र नही मिल सकेगा और न ही परिवहन यातायात किया जा सकेगा। इस अधिनियम के अन्तर्गत परिवहन यान की हालत ठीक होने पर ही प्रमाण पत्र जारी किया जायेगा, परिभाषित किया गया है।

मोटर वाहन अधिनियम की धारा- 56 के अनुसार

परिवहन यानों के ठीक हालत में होने का प्रमाण-पत्र-

(1) धारा 59 और धारा 60 के उपबंधों के अधीन रहते हुए परिवहन यान को धारा 39 के प्रयोजनों के लिए तभी विधिमान्यतः रजिस्ट्रीकृत समझा जाएगा जब उसके पास ऐसे प्ररूप में जिसमें ऐसी विशिष्टियां और जानकारी दी गई हैं, जो केन्द्रीय सरकार द्वारा विहित की जाए ठीक हालत में होने का विहित प्राधिकारी द्वारा या उपधारा (2) में वर्णित किसी प्राधिकृत परीक्षण केन्द्र द्वारा दिया गया इस आशय का प्रमाण-पत्र हो कि वह यान इस अधिनियम और उसके अधीन बनाए गए नियमों की उस समय की सभी अपेक्षाओं की पूर्ति करता है:
परन्तु जहां विहित प्राधिकारी या प्राधिकृत परीक्षण केन्द्र ऐसा प्रमाण-पत्र देने से इन्कार करता है वहां वह यान के स्वामी को ऐसे इंकार के लिए अपने कारण लिखित रूप में देगा :
[परंतु यह और कि ऐसी तारीख, जो केन्द्रीय सरकार द्वारा विहित की जाए, के पश्चात् किसी यान को तब तक उपयुक्तता प्रमाणपत्र अनुदत्त नहीं किया जाएगा जब तक ऐसे यान का स्वचालित परीक्षण केन्द्र पर परीक्षण न कर लिया गया हो ।]
(2) उपधारा (1) में निर्दिष्ट प्राधिकृत परीक्षण केन्द्र से कोई प्रसुविधा अभिप्रेत है, जिसके अंतर्गत राज्य सरकार द्वारा प्राधिकृत स्वचालित परीक्षण प्रसुविधा है, जहां ऐसे केन्द्रों की मान्यता, विनियमन और नियंत्रण के लिए बनाए गए नियमों के अनुसार उपयुक्तता परीक्षण संचालित किया जा सकेगा।
(3) उपधारा (4) के उपबंधों के अधीन रहते हुए, ठीक हालत में होने का प्रमाण-पत्र उतनी अवधि के लिए प्रभावशील बना रहेगा जितनी केन्द्रीय सरकार द्वारा इस अधिनियम के उद्देश्यों को ध्यान में रखते हुए विहित की जाए।
(4) विहित प्राधिकारी ठीक हालत में होने के प्रमाण-पत्र को ऐसे कारणों से, जो लेखबद्ध किए जाएंगे, किसी भी समय रद्द कर सकेगा यदि उसका समाधान हो जाता है कि जिस यान के संबंध में वह प्रमाण-पत्र है वह अब इस अधिनियम की और उसके अधीन बनाए गए नियमों की सभी अपेक्षाओं की पूर्ति नहीं करता है, और ऐसे रद्द किए जाने पर यान के रजिस्ट्रीकरण प्रमाण-पत्र को और यान के बारे में अध्याय 5 के अधीन दिए गए परमिट की बाबत यह समझा जाएगा कि वह तब तक के लिए निलंबित कर दिया गया है जब तक ठीक हालत में होने का नया प्रमाणपत्र अभिप्राप्त नहीं कर लिया जाता:
[परंतु विहित प्राधिकारी द्वारा ऐसा रद्दकरण तब तक नहीं किया जाएगा जब तक,-
(क) ऐसा विहित प्राधिकारी ऐसी तकनीकी अर्हता न रखता हो, जो केन्द्रीय सरकार द्वारा विहित की जाए और जहां विहित प्राधिकारी तकनीकी अर्हता नहीं रखता है, ऐसा रद्दकरण ऐसी अर्हता रखने वाले किसी अधिकारी की रिपोर्ट पर किया जाएगा, और
(ख) किसी उपयुक्तता प्रमाणपत्र को रद्द करने के लेखबद्ध कारणों की यान के स्वामी, जिसके उपयुक्तता प्रमाणपत्र को रद्द करने की वांछा की जा रही है, द्वारा चुने गए प्राधिकृत परीक्षण केंद्र में पुष्टि की जाएगी:
परंतु यह और कि यदि रद्दकरण की प्राधिकृत परीक्षण केंद्र द्वारा पुष्टि कर दी जाती है तो परीक्षण करने की लागत को परीक्षण किए जा रहे यान के स्वामी द्वारा और अन्यथा विहित प्राधिकारी द्वारा वहन किया जाएगा।
(5) इस अधिनियम के अधीन दिया गया ठीक हालत में होने का प्रमाण-पत्र जब तक प्रभावशील बना रहता है तब तक वह संपूर्ण भारत में विधिमान्य होगा।
(6) इस धारा के अधीन विधिमान्य उपयुक्तता प्रमाणपत्र रखने वाले सभी परिवहन यान उनकी बाडी पर स्पष्ट और सहज दृश्य रीति में ऐसा सुभिन्न चिह्न लगाएंगे, जो केन्द्रीय सरकार द्वारा विहित किया जाए।
(7) ऐसी शर्तों के अधीन रहते हुए, जो केन्द्रीय सरकार द्वारा विहित की जाएं, इस धारा के उपबंधों का गैर-परिवहन यानों पर विस्तार हो सकेगा।

Certificate of fitness of transport vehicles-
(1) Subject to the provisions of sections 59 and 60, a transport vehicle shall not be deemed to be validly registered for the purposes of section 39, unless it carries a certificate of fitness in such form containing such particulars and information as may be prescribed by the Central Government, issued by the prescribed authority, or by an authorized testing station mentioned in sub-section (2), to the effect that the vehicle complies for the time being with all the requirements of this Act and the rules made thereunder :
Provided that where the prescribed authority or the authorized testing station refuses to issue such certificate, it shall supply the owner of the vehicle with its reasons in writing for such refusal :
[Provided further that no certificate of fitness shall be granted to a vehicle, after such date as may be notified by the Central Government, unless such vehicle has been tested at an automated testing station.]
(2) The “authorised testing station” referred to in sub-section (1) means any facility, including automated testing facilities, authorised by the State Government, where fitness testing may be conducted in accordance with the rules made by the Central Government for recognition, regulation and control of such stations.
(3) Subject to the provisions of sub-section (4), a certificate of fitness shall remain effective for such period as may be prescribed by the Central Government having regard to the objects of this Act.
(4) The prescribed authority may for reasons to be recorded in writing cancel a certificate of fitness at any time, if satisfied that the vehicle to which it relates no longer complies with all the requirements of this Act and the rules made thereunder; and on such cancellation the certificate of registration of the vehicle and any permit granted in respect of the vehicle under Chapter V shall be deemed to be suspended until a new certificate of fitness has been obtained :
[Provided that no such cancellation shall be made by the prescribed authority unless,-
(a) such prescribed authority holds such technical qualification as may be prescribed by the Central Government and where the prescribed authority does not hold the technical qualification, such cancellation is made on the basis of the report of an officer having such qualification; and
(b) the reasons recorded in writing cancelling a certificate of fitness are confirmed by an authorised testing station chosen by the owner of the vehicle whose certificate of fitness is sought to be cancelled :
Provided further that if the cancellation is confirmed by the authorised testing station, the cost of undertaking the test shall be borne by the owner of the vehicle being tested and in the alternative by the prescribed authority.]
(5) A certificate of fitness issued under this Act shall, while it remains effective, be valid throughout India.
(6) All transport vehicles with a valid certificate of fitness issued under this section shall carry, on their bodies, in a clear and visible manner such distinguishing mark as may be prescribed by the Central Government.
(7) Subject to such conditions as the Central Government may prescribe, the provisions of this section may be extended to non-transport vehicles.
