किशोर न्याय अधिनियम की धारा 7 (बोर्ड के संबंध में प्रक्रिया) | Juvenile Justice Act Section 7 (Procedure in relation to Board)

किशोर न्याय अधिनियम JJ Act (Juvenile Justice Act) की धारा -7 के विषय में पूर्ण जानकारी देंगे। किशोर न्याय अधिनियम की धारा-7 मे किशोर न्याय बोर्ड के सम्बन्ध मे प्रक्रिया को परिभाषित किया गया है।

किशोर न्याय अधिनियम की धारा- 7 हिन्दी एवंम् अग्रेंजी मे

बोर्ड के संबंध में प्रक्रिया-

(1) बोर्ड ऐसे समय पर बैठक करेगा और अपनी बैठकों में व्यापार के संचालन के संबंध में ऐसे नियमों का पालन करेगा, जैसा कि निर्धारित किया जा सकता है और यह सुनिश्चित करेगा कि सभी प्रक्रियाएं बच्चों के अनुकूल हैं और यह स्थान बच्चे को भयभीत नहीं कर रहा है और नियमित अदालतों के समान नहीं है।
(2) कानून का उल्लंघन करने वाले बच्चे को बोर्ड के किसी एक सदस्य के समक्ष पेश किया जा सकता है, जब बोर्ड की बैठक नहीं हो रही हो।
(3) बोर्ड के किसी भी सदस्य की अनुपस्थिति के बावजूद एक बोर्ड कार्य कर सकता है, और बोर्ड द्वारा पारित कोई भी आदेश कार्यवाही के किसी भी चरण के दौरान किसी भी सदस्य की अनुपस्थिति के कारण अमान्य नहीं होगा: बशर्ते कि कम से कम दो हों मामले के अंतिम निपटारे के समय या धारा 18 की उप-धारा (3) के तहत आदेश देने के समय उपस्थित प्रधान मजिस्ट्रेट सहित सदस्य।
(4) अंतरिम या अंतिम निपटान में बोर्ड के सदस्यों के बीच किसी भी मतभेद की स्थिति में, बहुमत की राय प्रबल होगी, लेकिन जहां ऐसा बहुमत नहीं है, प्रधान मजिस्ट्रेट की राय मान्य होगी।


Procedure in relation to Board-

(1) The Board shall meet at such times and shall observe such rules in regard to the transaction of business at its meetings, as may be prescribed and shall ensure that all procedures are child friendly and that the venue is not intimidating to the child and does not resemble as regular courts.
(2) A child in conflict with law may be produced before an individual member of the Board, when the Board is not in sitting.
(3) A Board may act notwithstanding the absence of any member of the Board, and no order passed by the Board shall be invalid by the reason only of the absence of any member during any stage of proceedings: Provided that there shall be atleast two members including the Principal Magistrate present at the time of final disposal of the case or in making an order under sub-section (3) of section 18.
(4) In the event of any difference of opinion among the members of the Board in the interim or final disposal, the opinion of the majority shall prevail, but where there is no such majority, the opinion of the Principal Magistrate, shall prevail.
